Trump administrator is blocked from termination of legal aid for underage migrants unaccompanied

Federal Judge in California blocked Trump administration from stopping the legal lawyer for underage migrants unaccompanied.

Appointed President Joe BidenDistrict US District Judge Martine-Olguin from San Francisco issued a temporary restraint on Tuesday, which will prevent Trump’s administration stop financing, while the merits of the main case are played.

On March 21, the Trump administration stopped a contract with the Acacia Justice Center providing legal services to the migrants without escorting 18 years through a network of legal groups that a subcontractor centered. Eleven subcontractors have sued, saying that 26,000 children risk losing lawyers; Acacia is not a plaintiff.

These groups claimed that the government is obliged to provide a legal lawyer in accordance with the law on combating trafficking in human beings in 2008.

At his disposal on Tuesday, Martinez-Alguin said supporters raised legal issues about violations of the 2008 law, which guaranteed a return to the status quo while the case continues.

“The court further believes that further financing of the legitimate representation of children without accompaniment contributes to the effectiveness and justice in the immigration system,” she wrote.

This is the third legal failure in less than a week for the repression of the Trump administration, although everything may be temporary if the lawsuits have advanced.

The 2008 victim protection law has created a special protection for migrants who cannot navigate the complex immigration system independently. The plaintiffs said that some of their customers are too young to speak and others are too injured and do not know English.

The defendants, who include the Ministry of Health and Human Services and its refugee resettlement, said taxpayers are not obliged to pay direct legal assistance to migrant children at a time when the government is trying to save money.

Acacia is under a new contract with the government to grant legal orientation, including the “Know Your Rights” clinic.

The plaintiffs said they did not ask that the contract would be restored, but instead wants to return to the status of -quo – which spent $ 5 billion, which the congress has assigned so that the children had a representation, Karen Tumlin stated in the court hearing.

Jonathan grew up with the Ministry of Justice that the government still finances legally necessary events, such as the “Know Your Rights” clinics, and that legal clinics can offer their services without a fee.

“They can still provide these services,” he said.
