The US Appeal Court has ruled that President Donald Trump could support control of the National Guard troops, which he posted in the Los -Andeles, despite the objections of city leaders and California Governor Gavin Newsom.
Trump has launched troops in response to extensive protests against his immigration repression. Local officials called it an unnecessary provocation.
The panel of three judges said on Thursday that it was within its order to order for troops to work in “Protect Federal Staff … (and) Property”. Trump called it a “great victory”.
The decision stops the ruling from the judge of the lower court, which found that Trump acted illegally when mobilizing troops.
In this early decision, Judge Charles Brayer stated that Trump “did not” follow the law appointed by the Congress on the deployment of the National Guard of the state.
“His actions were illegal … Therefore, he should return control of the California National Guard of the Governor of California,” he wrote in his decision.
However, the judge remained ordered until June 13 to give Trump administration to appeal it, which she did almost immediately after.
The unanimous ruling on Thursday stated that “failure to comply with the order of federalization directly” through “the” California governor, does not restrict him otherwise legitimate powers to call for the National Guard. “
“This is much more than Gavin (Newsom) because throughout the US, when our cities and our people need protection, we must give them when they need the state, and local police for any reason to do the job,” Trump wrote on social media after the decision.
He also congratulated the court, adding: “America is proud of you tonight!”
However, in the 38 pages of the judge did not agree with the president on the essence of the legal problem against its use of the National Guard. It states that his decision to use the troops was not “completely isolated from the trial”.
Newsom replied to this decision, saying that the court “rightly rejected Trump’s statement that he could do everything he wants with the National Guard and should not explain himself to the court.
“We will not allow this authoritarian use of military soldiers against citizens without control,” he wrote on X, adding: “Donald Trump is not a king and not higher than the law.”
The court’s decision allows you to continue deploying about 4,000 troops in Los Anegles. Trump’s administration states that they defend federal immigration agents and federal property during the raids.
It states that it took the National Guard of California to restore the order and protect the immigration and customs agents (ICE) when they were raids on the Los -Andeles to detain the people they thought in the country illegally.
Trump also ordered the city of 700 Marines, despite the objections of Newsom.
The National Guard was last deployed by the president without the consent of the governor in the civil rights era more than 50 years ago.
