The US Supreme Court has ordered the Trump administration to promote the return of a man Maryland, who was mistakenly deported to the notorious mega-Jelon Salvador.
Trump’s administration acknowledged that Kilmar Abreg Garcia was deported by accident, but appealed to the lower court to return it to the United States.
On Thursday, 9-0 ruling, the Supreme Court refused to block the lower court order.
The judge’s order “demands that the government” promote “the release of both Garcia from the guardianship in El Salvador and make sure his case was considered if he was not incorrectly sent,” the judges ordered.
Mr. Garcia, who is now 29, has entered the US illegally in adolescence from Salvador. In 2019, he was arrested by three more men in Merilend and detained by federal immigration bodies.
But the Immigration Judge gave him a defense against deportation on the grounds that he could risk the persecution of local gangs in his home country.
It is in prison for maximum security in Salvador, known as the CECot Center (CECOT), as well as hundreds of other men who have been deported over the past few months on charges of criminal and gang.
His wife Jennifer Vaskes Sura is a US citizen and called for release. He was reportedly working as a leaf metal worker when he was detained on March 12.
On April 4, Judge Pavel Sinis from the district court Maryland ordered the Trump administration to “promote and carry out” Mr. Garcia’s return.
The government said Mr. Garcia was deported on March 15 due to an “administrative mistake”, although they also claim that he is a member of the MS-13 gang, which his lawyer denies.
In her emergency address to the Supreme Court in America, the Trump administration claimed that Judge Maryland lacks the powers to issue an order, and that US officials cannot force Salvador to return Mr. Garcia.
US General Lawyer J. John Sauer wrote in his statement in an emergency court: “The United States does not control the sovereign nation of Salvador, and he cannot force Salvador to follow the federal judge.”
He added: “The Constitution accuses the president, not the federal district courts, in conducting foreign diplomacy and defense of the nation from foreign terrorists, including by fulfilling their removal.”
On Monday, the Supreme Court posted temporarily on the order of the lower court when they considered the case.
