The efforts of the Trump administration will deprive hundreds of thousands of Venezuelan and Haitian migrants illegal, the American judge says.
District Judge’s ruling Edward Ceno cancels the Attempts of the Department of Homeland Security (DHS) to stop the temporary protected status (TPS) for people from countries that feel the conditions that make it dangerous to return.
This will allow about 600,000 Venezuelans and 500,000 Haitians to continue living and legally working in the US. DHS noted that it would appeal the decision.
The TPS program was created by Congress in 1990 to provide temporary protection of migrants from countries undergoing war and natural disasters.
In the decision on 69 pages, Judge Chen wrote that DHS secretary Christie Noah in abolishing their secure status “was not only unprecedented in order and speed in which he was adopted but also violated the law.”
He said the conditions in his countries were “so dangerous that even the State Department advises against trips.”
In response to the DHS press, the DHS told the BBC that the scheme was “abused, exploited and politicized as an actual amnesty program”, pointing that it evaluates its legitimate options.
“Unforough activists cannot stop the will of the American people for a safe and safe homeland,” the press secretary added.
There are about 600,000 migrants having TPS from Venezuela, the largest country that is included in the program. Former President Joe Biden has expanded the program to include Haiti, Afghanistan, Cameroon and Ukraine.
President Donald Trump sought change the extension When he returned to the post earlier this year, he also tried to stop the appointment for Venezuela.
In March the administration that makes a good Trump’s promise about stopping immigration, stated that would be withdraw temporary legal status With more than half a million migrants from Cuba, Haiti, Nicaragua and Venezuela.
Those migrants were warned to leave the country before their permits and deportation shields were canceled on April 24.
The National Alliance’s National Alliance and Venezuelan Alliance TPS sued the Trump and DHS administration earlier this year, claiming that NOEM had no unilateral repayment powers provided by the previous administration.
In May, The Supreme Court froze the previous decision And it allowed Trump administration to stop the TPS program for hundreds of thousands of Venezuelans.
But Judge Chan, the California federal judge, said on Friday that the Supreme Court’s decision was considered only with previous relief.
He did not turn him off, he wrote, issuing fresh orders.
Also on Friday, the Federal Appeal Court in Washington ruled that the Trump administration could not continue to reduce foreign aid.
The ruling requires the administration to move quickly to spend money on the projects allowed by Congress.
The administration contained $ 4 billion (3 billion pounds) in financing, appointed US Agency for International Development, which was selected during Trump’s second term.
