Apple Judge Ivon Gonzalez Rogers said the decision of the Epic Games in 2021 on Wednesday.
She wrote that Apple’s Vice President Alex Roman “immediately lied to the court about when Apple decided to recover 27% fee for some purchases -related apps.
“Neither Apple nor his lawyer corrected, now obvious, lies,” Rogers wrote, saying she believed that Apple “accepted the lies and the wrong submission in this court.”
Rogers added that she had handed over to the US lawyers to investigate whether it was necessary to prosecute the criminal disrespect for Roman and the apple.
The decision is an amazing rejection of Apple’s behavior in the Epic Games trial, which was adopted in 2021 and was appealed in 2023.
While Apple won the vast majority of columns in the original lawsuits, Epic Games won Some concessions laid in an order for 180 pages: Rogers initially ordered Apple to make changes to his app store, which allowed applications manufacturers to tie them Web -Sayts inside iPhone apps in order for customers to shop.
On Wednesday, Rogers accused Apple of intentionally attempted to violate his ruling and charging Apple.
Rogers says that her decision was expected that such purchases outside the app would not have Apple commission. But Apple has introduced a new policy in 2024, which collected a 27% commission from some of these purchases, only a small 30% Apple discount usually collected from purchases in the application. Rogers said virtually every Apple’s decision on its policy, which linked the application, was anti -competitive.
Rogers wrote that Apple provided evidence of the court about internal reflections on its rules that were “developed for court proceedings” rather than the real internal discussions of Apple.
“Unlike Apple’s initial indications, modern business documents show that Apple knew exactly what he was doing, and at every step she chose the most anti-channel option,” Rogers wrote. “To hide the truth, Vice-President of Finance Alex Roman immediately lied under the oath.”
Rogers also accused Apple of maintaining the documentation at the June 2023 meeting, including CEO Tim Cook on how they will comply with the 2021 court ruling. Rogers said Apple hid the existence of a meeting with the court until 2025.
She also said Apple abused the privilege not to share the documents.
Rogers ordered to act immediately to Apple to put its commissions on purchases made for iPhone applications through the web monster in the application.
“This is a ban, not negotiations. After the party intentionally ignores the court ruling,” Rogers wrote.
Apple’s representative did not respond to a comment request. The Epic Games representative did not immediately have a comment.
