Syria receives a temporary constitution for a five -year transition

Syria’s temporary President Ahmed al-Sharaa signed a constitutional declaration that covers the five-year transition period, three months after his Islamist group led the offensive rebel that overthrew Bashar al-Assad.

The document states that Islam is the president’s religion, as well as the previous constitution, and the Islamic jurisprudence is the “main source of the legislation”, not the “main source”, the commission reports.

It also enshrines the separation of powers and judicial independence, as well as guarantees the rights of women, freedom of expression and freedom of the media.

“We hope it will be a new story for Syria, where we replace the oppression for justice,” Sharaa said.

UN Special Envoy Gire Pedersen said he welcomes “steps to restore the rule of law” and noted that “this development potentially fills the important legal vacuum.”

But the administration under the leadership of Kurd in northeastern Syria criticized the constitutional declaration, saying that “contradicted Syria’s reality and its diversity.”

In January, the insurgent military commanders called President Sharaa for the transition period, abolished the Constitution of the Assad 2012 and dissolved the parliament, army and security agencies of the former regime.

Only 10 days ago, Sharaa announced the formation of a semical committee on the development of the constitutional declaration, which, he said, will serve as a “legal framework that regulates the transitional stage”.

Member of the Committee Abdul Hamid Al-Avak, an expert on constitutional rights, which he teaches at Turkish University, said on Thursday a press conference that the declaration was aimed at “creating a balance between security and rights and freedoms”.

He said it stipulated a “absolute separation of powers”, pointing to the “assassination of Assad” on other branches of government during his 24-year government.

According to him, the president will have the executive power in the transition period, but will have only one “exceptional power” – an opportunity to declare a state of emergency.

The new People’s Assembly will have full responsibility for the legislation. Two -thirds of his members will be appointed a committee elected by the president, and the third, the president himself.

The Committee will also be created to develop a new constant constitution.

Sharaa has promised an inclusive government that will govern the country until the new constitution is completed and free elections are held.

However, he faces significant problems after the devastating civil war that broke out when Assad ordered severe repression against democratic protests 14 years ago.

UN Secretary -General Antonio Guteres said on Thursday that he could not justify the murder of civilians and warned that “a very deserved bright future in Syria is hanging in equilibrium.”
