The federal judge ordered the release of a Turkish student at the University of Tufts, which is being held in Louisiana after her immigration officials were arrested in Massachusetts.
The 30 -year -old Rames Ozturk testified virtually at the court hearing on Friday, where the US District Judge William sessions said the student had met all the conditions necessary for release and secured the government against it, the BBC News CBS reports.
“Her further detention cools the speech of millions in this country that are not citizens,” the judge said.
Ms Atsurka co -authority in her campus newspaper, which was a critical war with Israel. Its arrest stems from the White House repression that it classified as anti -Semitism on US campus.
The US Internal Security Ministry has accused Ms. Osturka of “Engag) of supporting a foreign terrorist organization Hamas, which is enjoying the killing of Americans.” During the hearings, the government did not call it with witnesses.
Following the judge’s ruling, the DHS press secretary replied: “Visas provided by foreign students live and study in the United States are privilege, not right. Trump administration seeks to restore the rule of law and common sense for our immigration system and will continue to fight for arrest, detention and removal.”
Video of the arrest of Ms. Osturka in March, showing disguised officers with simple masonry who handcuffed it and took it into the unbroken car after Ramadan’s celebration, summoned protests.
Earlier this week, the judge ordered Ms. Otsturk to be transferred until May 14 by immigration to Vermont, where she was last carried out before she was taken to Louisiana.
The judge said on Friday that it should be released immediately without restrictions on the travel so that it can go to Vermont or Massachusetts, where the tufts is located as needed.
He heard from a number of witnesses in this case, including Ms. Osturka, her doctor and professor at the University of TufeS.
During her testimony, Ms. Osturk told the court about her fulbright scholarship and doctoral work. She said her asthma condition deteriorated during the detention, and at one point had to take a short break after the asthma attack was injured.
After obeying the defense witnesses, the judge said that Ms. Osturk expressed “very significant” statements that her first amendment and proper rights were violated. He said that the only evidence that the administration had against Ms. Osturka was her op-med.
“This is literally so,” he said, according to the court journalists. “There is no evidence that she was violent or advocated for violence.”
In his statement, the US Union of Civil Liberties, representing Ms. Osturk, said they were “delighted” of its release.
“Now Rümeysa can return to his favorite Tufts community, restore his studies and start teaching again,” said Nuar Zafar, senior prosecutor of ACLU staff. “Today’s ruling emphasizes the vital principle of the first amendment: the government should not be imprisoned for expressing their beliefs.”
The judge of the sessions said in court that the government should inform him if Ms. Osturka would be released and said he would refuse any petitions to block her release.
Trump’s administration has detained several foreign students – some legal residents who organized Palestine.
Last week, the judge ordered the government to release Mohdavi Colombian Student Mahdavi after immigration officials detained him during an interview with naturalization.
A 34-year-old permanent resident was resolved at the refugee camp on the west bank and was held in Vermon.
One of the highest cases is still linked to Colombia’s graduate Mahmoud Khalil, a well -known pro -Plestin activist who remains Louisiana’s detention without charges.
