“Her modified complaint was deprived of any actual allegations that she was subjected to purposeful discrimination, in addition to claiming as much in the most final order,” Judge Vendy Bethlstown wrote in her decision. “It indicates cases where students assigned to women at birth are different than those who are appointed by men at birth, and thus she failed to apply for sex discrimination.”
Plaintiff Prosecutor Keith Altman said he would appeal the decision.

“Obviously the client is disappointed and still strongly believes in what has happened,” Altman said for NBC Philadelphia. “We will continue to deal with this issue. We believe that this is an extremely important issue and we need to solve it.
“Undoubtedly, men, as a common opinion, are more physically capable than women. We believe it is fundamentally unfair, who just says,” Well, I am identical as a woman, “now capable of competing with women and dominated in women’s athletics. It just doesn’t make sense.”
