According to Crowder, such disputes can often become “proxy wars” for family members to “work out long -standing issues” which began long before the death of an individual.

“One of the threshold issues in this case appears to be whether some tangible personal property items were owned by Ms Pickler or her husband,” said Crowder. “Ms Pickler has claimed that the Jacobses entered her and her husband’s home and took possession of some items. If those items were, in fact, the property of Ms Pickler, the jacobses had no authority to take possession of them and act inappropriately in doing so.”

Crowder, however, acknowledged that Reed and Sharon were “authorized under Tennessee law” to take possession of the tangible personal properties of Jacobs as they are his estate administrators.

“Determining ownership of such properties can be complicated. It may include tracking the source of the money used to purchase the items,” added Crowder to Us. “For example, did the money came from Ms. Pickler’s employment, or from her husband’s men? In addition, a spouse can enter into contracts about the ownership of their property, often through wooden or post -name agreements.”

Pickler and Jacobs signed woodup when they married in 2011, which Reed and Sharon have been used as a reason why the singer’s legal request should not be given.

“The court will probably need to interpret that contract to decide what the parties agreed to in terms of ownership,” said Crowder. “In so far as the court decides that Ms. Pickler’s husband owns some or all of the property, the Jacobses have the right to collect that property as the estate administrators. Some or all of that property could be sold when administering the estate, if necessary, to pay debt and expenses.”

Once any debts and expenses are paid, it is up to an administrator to distribute the remaining property to the heirs of the estate. As Pickler and Jacobs did not have children, Tennessee’s law usually allocates the whole estate to the person’s spouse.

“Under the default rules, Ms Pickler would be entitled to all her husband’s property after the estate was administered by the Jacobses. However, a married right to inherit by contract can be modified,” said Crowder Us. “Many people believe that a wooden agreement addresses property division in divorce only, but can also address the rights of the spouse to each other’s estate after death. In addition, it is possible for a deceased person’s family to reach an agreement among each other about sharing property.”

Many of the details of the legal battle are set under a seal for better privacy. Earlier this month, Reed and Sharon also Subpoena filing To Harpeth’s Memorial Gardens Funeral and Cremation Center for more details on the Jacobs funeral service and cremation plans.
