The Salvadoran man, who was mistakenly deported and then returned to the US in the criminal case, was released from prison, his lawyer said at the BBC.
“Today, Kilmar ábrego García is free,” said lawyer Sean Herker. He planned to return to his family in Merilend.
In March, Mr. Obreg Garcia was deported to his native Salvador as part of the repression of Immigration Donald Trump, where he was held in the Slavic Secott prison. At that time, US government officials acknowledged that he was dismissed mistakenly.
He was returned to the United States earlier in June and sent to Tennessee, where he was accused of human smuggling scheme. He is not guilty.
His lawyers say it will be the first time he can completely reunite with his family because he has been deported from March. He has a wife and two children.
“Today was a very special day because I first saw my family in more than 160 days,” Mr. Abreg Garcia said in a statement after his release.
He says he is grateful to everyone who supported and prayed for him.
“Today I am grateful to God because he heard me and today I go out. We are coming to justice, but justice was not fully submitted,” he said.
The release of the Dr. Obreg Garcia is a blow to the Trump administration, who firmly stood for his deportation and promised that “never will be released” on American soil.
His lawyers say they are worried that Mr. Abreg Garcia can again take the immigration authorities when he arrives in Maryland and worried that he could be deported to another country.
US Interior Security Minister Christie Noah criticized the judge for allowing him to release.
“By ordering this monster on the streets of America, this judge showed a complete ignoring security of the American people,” she said in a BBC statement.
“We will not stop fighting as long as this man is angry with justice and will not be outside our country.”
Kilmar Abrega Garcia illegally entered the US in adolescence from Salvador. In 2019, he was arrested by three more men in Merilend and detained by federal immigration bodies.
Later, in the same year, he was granted protection against an immigration judge as it was found that he could face the danger from the gangs when they returned to his native Salvador.
But in March 2025, Maryland’s resident was deported and initially conducted Salvador’s Salvador’s mega, which later admitted that Trump administration officials were a mistake. The judge ordered the government to “promote” his return, but the White House officials initially refused to return it.
Upon returning to a person’s smuggling in June, Prosecutor General Bondi said “this is what American justice looks like.”
He denied any violations, and his lawyers called allegations of human trafficking.
At the end of June, a federal judge in Tennessee ruled that Mr. Abreg Garcia was entitled to release, but remained in prison for fears of his own legal team that he could be quickly deported if he leaves the object.
Trump’s administration said it could seek it and go to Mexico or South Sudan.
The judge ordered the administration to inform the lawyers if they seek to deport Mr. Abreg Garcia.
