FIRST ON FOX — A new study sounds the alarm about female-identifying, biologically male criminals in women-only prisons, saying those inmates are posing physical and psychological risks to biological women.

“That’s because the laws are based on self-identification. The only requirement is that someone declares that they are female,” Ichikawa told Fox News Digital. “You cannot base your rejections on physical characteristics, including penile retention. You can’t deny someone a transfer based on a criminal history.”

Male inmates who identify as women often go before the review board to hear cases alleging that sex-based prisons violate equal protection laws or that they are discriminated against on the basis of their sex.

Transgender, biologically male prisoners will also argue that their conditions in male-only prisons violate the Eighth Amendment’s ban on cruel and unusual punishment, according to a report by Independent Women.

These states include California, Connecticut, Maine and New Jersey. Two states — Utah and Louisiana — prohibit men from being held in women’s prisons, while all others act individually.

As of October 2024. there were 1,487 men who identified as women in federal prisons. According to the Federal Bureau of Prisons (BOP), only a few are in women’s prisons.

Nearly half of trans-identifying male inmates have sex-related convictions, compared to less than 12% of the male prison population nationwide, according to BOP statistics cited in a report by Independent Women.
