The US judge temporarily blocked the Trump administration’s attempt to deport dozens of invalid Guatemala’s children back to his native country.
The District Court Judge sparkle Suknanan on Sunday was in response to reports that the children were put into planes and were going to send to Guatemala, where lawyers claim that they would risk abuse and persecution.
The children only arrived in the US and are in custody of the government while their immigration requirements are evaluated.
Lawyers of the US Department of Justice stated that the children were not deported, but rather reparers so that they could reunite with the family.
Legal affairs were summoned early on Sunday when the immigrant promoting groups were asked for an emergency ban, saying that about 600 children could be put on Texas planes and deport.
Then Judge Souknanon issued a temporary restraint that prohibits officials from sending a group of 10 migrants aged 10 to 17 years to Guatemala.
At a hasty hearing on Sunday afternoon Judge Swananan, nominated by former President Joe Biden, expanded the order for children without escort, allegedly risking deportation. The order will be created within 14 days.
At the hearing, Judge Suoknanon sought assurances from the lawyers of the Trump administration that the planes had not yet left the children on board.
Deputy Assistant Prosecutor General Drey Warner said all planes were “on the ground” in the USA. He told the judge, one plane may have shot down, but returned.
The ensign said the flights were not part of deportation efforts, but for family reunification with parents and other relatives in Guatemala.
He also said that the Guatemala government and child relatives asked for reunion. The proposal groups said that at least in some cases was not true.
In court statements, lawyers for children claimed that the action violated federal laws aimed at protecting children arriving in the United States. They said that some children had considered cases before immigration judges and expressed reliable fears about returning.
“On the dead night, the Trump administration broke away the vulnerable, frightened children from the beds and tried to return them to Guatemala,” the statement of the EFRENA ALILES of the National Legal Center, which filed the lawsuit, said.
“We warmly launched a court that prevented this injustice before hundreds of children caused irreparable damage.”
The White House Immigration Advisor Stephen Miller criticized the judge for blocking flights.
“In the juveniles, everyone reported that their parents returned home to Guatemala,” he wrote on X. “But the Democratic Judge refuses to allow them to reunite with their parents.”
Since the beginning of his second term, Trump has started extensive efforts to remove undocumented migrants – a key promise in the elections that attracted mass support during this campaign.
In June, The US Supreme Court cleaned the way To Trump restore migrants’ deportations in other countries except for his homeland, preventing them from raising the risks they may face.
