The Australian politician and the convicted rapist left the parliament a few minutes before he was expelled, after losing the legal task.
Last month, Gareth Ward Ward was found guilty of a sexual attack on two young people between the ages of 18 and 24, between 2013 and 2015, and is now in custody before the sentence.
Earlier this week, Ward launched a legal application for the termination of the Parliament of the new South Wales (NSW), but it was rejected on Thursday after the court rejected the arguments that the move was an “attack” on democracy.
The plans expel him on Friday were thwarted when, less than two hours before the vote for his removal was, Ward quit as an independent Kiama member.
Ward’s resignation letter was accepted by Parliament at 09:08 local time on Friday (00:08 GMT), shortly before the vote at 10:30, was supposed to expel him.
His resignation – the years after the first time allegations of sexual attack appeared – means that Ward will no longer receive a parliamentary salary.
It also calls the elections to the South-West Department of NSW, which has taken place since 2011.
In 2021, Ward abandoned the state minister and left the liberal party, but refused to leave the parliament and was re -elected in 2023.
During their legal challenge, Ward’s lawyers claimed that attempts to expel him from the parliament before completing the process of appeals were “the reason for the basis of representative democracy.”
NSW Prime Minister Chris Mins said on Friday that Ward’s resignation “was supposed to come earlier.”
“If you are convicted of some most serious accusations – a sexual attack on NSW – you cannot sit as a parliamentary participant, attracting a parliamentary salary,” the work leader said.
“How can you represent your community with -wit?”

Ward, who should be convicted next month, said he intends to appeal the verdict of the guilty.
