The Court of Appeal threw a fine of $ 500 million (£ 372 million, which to President Donald Trump was ordered to pay in court in a civil fraud in New York last year.
Judge Arthur Engonon ordered Trump to pay for the mass inflating value of the Trump organization to provide favorable loans.
In a long ruling, published on Thursday, the judge of the Supreme Court of the Supreme Court of New York said that while Trump was responsible for the fraud, the fine for almost half a billion dollars was excessive and probably violated constitutional protection against severe punishment.
In this case, Judge Engonon ordered Trump to pay $ 355 million, but with a percentage that grew to more than $ 500 million.
“Although the damage, of course, has come, not a cataclysted damage can justify the state nearly half a billion,” Judge Peter Multan wrote.
In a report on his social media website, “Truth” Trump said the decision was a “complete victory”.
“I greatly respect the fact that the court had the courage to throw away this illegal and shameful decision that harmed the business throughout the state of New York,” he said. “It was a political hunt for witches, in a business sense, similar to which no one has ever seen before.”
The Prosecutor General’s Office of the New York, which opened the case against Trump, also issued the decision as a victory because she supported the responsibility for Trump’s fraud, and the judges did not release other punishments that were not financial. The Office plans to appeal the decision on a fine to the Supreme Court of the State, the Appeal Court.
The statement of the Prosecutor General’s Office said that the judges “confirmed the well -maintained conclusion of the court of first instance: Donald Trump, his company and his two children are responsible for fraud.”
“It should not be lost in history: another court ruled that the president violated the law and that there is a merit in our case,” the statement reads.
In this case against Trump, two of his adult sons and Trump organization, Judge Engon also banned Trump to fulfill the duties of the company’s director or take out loans from banks in the state for three years.
The decision on Thursday was kept on the site of this and other non -non -ninth -fines imposed by Judge Engon.
The 323 pages, which included three prolonged opinions, revealed differences among five judges at the board.
First of all, they were divided into the essence of the initial trial, which brought James, who accused Trump and his sons of “persistent and repeated fraud”.
While several judges stated that she was “being within her legal force in the adoption of this action”, one believed that the case had to be rejected and two stated that there should be a new test of a more limited sphere.
However, the two joined the decision to throw away the fine “for the sole purpose of ensuring the finality,” Judge Multan writes.
The American voters “clearly sentenced” in Trump’s political career, also wrote Judge Multan, and “this bench today unanimously pulls his efforts to destroy his business.”
The ruling took place almost a year after the board heard oral arguments on the appeal, during which several judges were skeptical of the case of civil fraud.
Trump’s son Eric Trump, who participated in this case, noted the decision in the position in social media.
“After 5 years of hell, justice prevailed!” He wrote.
The ruling made a “judicial version of the banks on the road”, said that Will Thomas, an associate professor at the Department of Business Law at the University of Michigan.
“According to his own confession, the appeal courts advocate a true legal decision to the New York Appeal Court, noting that his unusual decision was made,” he said.
“It’s hard to draw from this conclusion … except that we will have to continue to wait much more time to learn about the end result in James against Trump.”
In September 2023, Judge Anngon ruled that Trump was responsible for fraud with business, believing that he incorrectly presented his wealth for hundreds of millions. Another trial was held in 2024 to determine the punishment.
In one case, the judge acknowledged that the financial report of Mr. Trump mistakenly claimed that his Penthaus Trump was almost three times that his actual size.
Trump said the case started by James, the Democrat, was politically motivated.
An extraordinarily prolonged ruling on Thursday also reflected a historical difficult situation on how to deal with the mass fraud with the participation of the president, said Mark Zadrer, a long -standing prosecutor in New York.
“Would you have 300 pages if it was Joe Smith businessman rather than Donald Trump?” asked Mr. Zadrer.
