Families Madison Mogen and Ethan ChapinTwo of the four Idaho College students murdered by Bryan KohbergerHas sued the city of Moscow, Idaho, for releasing crime scene photos.
When appearing on News BanfieldAttorney Leander James – The lawyer representing the families of Mogen and Chapin – he explained why they believed the legal proceedings is necessary.
“They had actually reached a point by the sentencing that they had closed a bit and could start moving on somehow,” James told a guest Brian Entin On Monday, August 18. “Then they are hit with this, all these ugly things are released.”
Although James has acknowledged that pictures are likely to be released because of the public interest relating to the murders, he hopes that “death scene photos” can remain private.
“Who wants to look at these things?” He asked. “This is totally wrong. As I, personally, I am a fan of the first amendment, I appreciate what the media does, and I appreciate the transparency and right of the public to know. But there’s a line there somewhere, and I think we’re over that line.”
In July, Kohberger something sentenced to four life sentences in prisonmore than two years after he murdered Mogen, Chapin, Kayleee goncalves and Xana Kernodle at their home in Moscow.
Weeks before his sentencing, Kohberger pleaded guilty to all four murders in exchange for avoiding the death penalty.

“This unpleasant and senseless act of evil has caused immeasurable pain and loss. No parent should ever have to bury their child,” judge Steven hippler identified in sentencing. “This is the biggest tragedy that can be caused to a person.”
In his latest interview with Newsnation, James explained why Mogen and Chapin families wanted to take legal action to prevent more photos of the crime from being released to the public.
“For them, I think it’s an unjustified invasion of their privacy for any of the inner photos to go out there, or any of the Gory photos,” he shared. “I think these core images are images of the death scene, the bodies and those kinds of things where the murders happened. Those, I think, are the most unpleasant and they avoid paying unruly and should not be released.”
Before a judge made a judgment on what can be released, if anything else, it can be released, James asked anyone who sees the images “to think of the parents and members of the family of these children who were killed and thinking about how they would feel if they were in their position and not see these pictures. Don’t look at them if they are out there.”
