A The man from Tennessee he was charged after he allegedly opened fire on a family sledding in the snow, claiming the family was on his property.
Benjamin Cook faces six counts of aggravated assault in connection with shooting, reports Hamilton County Sheriff’s Office. Additional charges may be filed pending the outcome of the investigation.
The sheriff’s office said deputies responded to the 6300 block of Stoney River Drive on Friday after reports of a man shooting at a family of six who were playing in the snow.
According to preliminary information from the scene, the parents and their four children were walking down the street to go sledding down the hill in their neighborhood, deputies said.
But around 11:30 a.m., the family reported hearing gunshots coming from the side of a house down the hill near the 10400 block of Birchwood Pike. A mother said she watched snow fly from the ground just meters away from her one-year-old son.
The parents immediately looked in the direction of the shots and yelled at the man, later identified as Cook, to stop shooting. The man claimed that the family was on his property, but the family replied that it was not on his property.
The family then packed their belongings and went home before reporting the incident to the authorities.
Deputies responded to the shooter’s home and spoke with Cook. They also obtained photos from a neighbor of Cook, similarly dressed, walking through the woods with a black rifle on his back.
Cook was then arrested on charges of aggravated assault.

The investigation also revealed that the family was not on Cook’s property when he started shooting.
A search warrant was executed at Cook’s home, where several rifles were found inside.
