Emilie Kiser’s husband Betrayal will not face Children’s Abuse accusations Following the drowning the death of their son Trigg, 3.
There is “no likelihood of conviction” against Brady, according to a new statement released by the Maricopa County Attorney Office on Friday, July 25.
Brady was home on his own watching Trigg and the Teddy couple’s son, 3 months, while Emilie was out with friends on May 12 when the tragic incident happened.
“A video of surveillance from outside the home showed how the drowning and actual timeline happened,” read the statement. “In order to convict a person of this accusation, the state must prove beyond reasonable suspicion of a unanimous jury that the individual has failed to detect a significant and unjustified risk, and that failure to find the risk is a gross deviation of the standard of care that a reasonable person would show.”
The MCAO added in the statement that, following a review of the evidence, it was unlikely that Brady would be convicted.
“All cases presented to the County Attorney Office Maricopa is evaluated using the same standard: is there a ‘reasonable likelihood of conviction.'” The statement continued. “Following a careful review of the evidence presented by Chandler PD, it was decided that this case does not meet that standard. The MCAO review of the case included the attorneys allocated to it, together with an experienced senior attorneys and the county’s own attorney.”
Brady’s attorney Flynn Carey He responded to the update in the case through a shared statement with a number of outlets.
“We are grateful to enforce the County’s law and attorney for conducting a thorough investigation and confirming that this is a tragic accident,” read the statement. “Brady remains in the mourning process and is grateful to be with his family as they improve together. We appreciate the compassion and support shown during this difficult time.”

“The Chandler Police Department has completed her tragic tragic drowning three-year-old Kiser. Following a thorough review of the evidence, researchers have recommended a Class 4 felony accusation of child abuse against Brady Kiser,” read the statement. “The case has now been submitted to the County Attorney Office Maricopa for review.”

Brady, who married Emilie in 2019, claimed that he was “soon distracted” by Teddy, who caused him to lose sight of Trigg for three to five minutes. He then claimed he found his son floating in the pit, by the documents.
Then the father said he jumped into the pool to restore his son and call 911.
