The Corporation for Oreo has launched a lawsuit against the US budget supermarket Aldi, accusing her of “brazen” copying of the famous snacks.
The court documents showed that Mondelēz International said Aldi uses a similar packaging that can “cheat” consumers and “ride on the” Attraction, Glory “company and prestige”.
The snack giant is also behind the wheat thin, Nutter oil, Chips Ahoy!, And Ritz – all the products that the company accuse ALDI of copying with its “discount” versions.
Aldi US did not respond to the BBC request for a comment, but his British counterpart emphasized that he was not involved in the trial.
ALDI UK’s press -secretary said they “under the same legal property, but work as completely individual enterprises.”
Mondelēz, who presented a lawsuit in May, said he repeatedly appealed to Aledi about “unclear similar packaging”.
Although ALDI stopped or changed the packaging of some products, the supermarket continued to make “unacceptable copies”, the lawsuit said.
The company claimed that if ALDI is allowed to continue its products, it “irreparably harm” the Mondelēz brand.
The lawsuit included images aside comparing the performances of the Mondelēz product with Aldi’s.
Aledi is accused of violating the brand, unfair competition and unfair enrichment in the trial. Mondelēz said he was looking for losses.
Mondelēz called the aldi business model as loops on “low-cost private labels that resemble the appearance of famous brands.”
ALDI, which has a headquarters in Germany, is known as a supermarket with a discount offer that offers affordable alternatives to the famous brand.
The US has more than 2500 ALDI shops.
This is not the first time Aldi was involved in the battle with a trademark. Earlier this year he lost the battle with the manufacturers of the Sidrav, who accused the supermarket of copying his drink to “taste and appearance”.
