Tesla human rights activist, who fought with Elon Musk and his company through the trials for years won the last round of the long -standing legal battle.
Engineer Christina Balan lost her job after in 2014 caused concern about security about the lack of design, which could affect the inhibition of cars.
Seem canceled this decision in its favor.
She told BBC News that she now wanted to face Elon Musk and Tesla in the open court.
Tesla did not respond to a comment request.
Ms Balan said she believed that the case would act in the “Square of the first” and could be launched new cases.
“We hope we will start a new lawsuit, and we will have the opportunity to take Elon Musk before the jury and the judges,” she said.
Once engineer was so noticeable in Tesla that its initials were engraved on the batteries inside the S.
In an interview with BBC News last year, She said she was determined to prove her innocence for her son.
She also showed that she was in remission from breast cancer on 3b, and her greatest care was that she couldn’t live to see the last day in court.
Ms Balan claimed that she was experiencing that carpets were curled up under some Tesla models, creating a security danger.
She said that the executives sting her concern, became hostile, and she lost her job.
Then she won the illegal case of dismissal – but it turned out to be a long journey through the courts.
Ms Balan was publicly accused by Tesla of using her resources for a “secret project” – charges that make up the thefts, the crime under the US law.
She consistently denied the prosecution and decided to launch a defamation case against the company in 2019.
“I want to clear my name,” she said BBC News last year.
“I want Elon Musk to apologize.”
The court then decided that the case of Ms Balan should be subject to the contract arbitration, which she signed while working on Tesla.
The referee recognized for the benefit of the company and Musk, rejecting its claims from the time of California – it means that it has been too much time since the alleged defamatory statements have been made.
Tesla returned the case to the California district court to confirm the decision.
However, Ms Balan appealed against the decision, and the judge of the US Appeal Court in the ninth constituency, recognized in her favor – in essence, deciding that the California court had no jurisdiction to make his decision.
They ordered to cancel the arbitration award, and the district court dismissed the lawsuit from the lack of jurisdiction.
