The man accused of hitting and killing Johnny and Matthew Gaureau He is alleged to ask for his friends to help him hide alcohol immediately after the incident, according to the brothers’ attorneys.
Sean M. Higginsfacing six charges including aggravated manslaughter and the killing of a di -hid vehicle at the deaths of August 2024 in Johnny, 31, and Matthew, 29, appeared in a court room in New Jersey on Tuesday, April 15, as his lawyers tried to convince a judge to throw parts of the indictment against their client.
Higgins has pleaded not guilty to all charges.
During his argument to support the cause, Salem Sir Assistant Prosecutor Michael Mtrael Higgins said Higgins did not call 911 after he claimed he hit Johnny and Matthew with his jeep while they were riding their bikes, back Columbus Send.
Mestern further argued that Higgins claimed he made calls to recognize others and tried to remove open and unopened alcoholic beverage containers that were inside their SUV.
When the State of New Jersey police eventually reached the location, Higgins admitted to eat “five to six beers” before the incident. He also admitted drinking while operating the vehicle.
The blood-alcohol level of Higgins .087, is allegedly over the legal limit of .08.
Much of the hearing on Tuesday was centralizing around Alleged blood alcohol levels Johnny and Matthew. In a court filing in February, it was revealed that Johnny had a blood-alcohol concentration of 0.129% when he was killed, while Matthew’s concentration was 0.134%.
Higgins’ attorneys, Matthew Portella and Richard KlineburgerHe said prosecutors had not submitted evidence to the prestigious jury about the blood-alcohol levels of the Gaureau brothers.
In front of Tuesday’s court room crowd which included Johnny and Matthew’s parents, Boo and Janidtheir sisters, Katie and Christ and Katie’s fiancé, Devin JoycePortella broke lightly when he discussed drinking the brothers on the night of their deaths.
“We don’t blame the two cyclists for the incident,” said Portella. “That would be absurd. That would be wrong.”
Higgins attorneys have also tried to argue that their client was unaware that he collided with Johnny and Matthew on the night of the event, which criticized Mustern on Tuesday.
“It is impossible for someone with a straight face to do so much damage to a vehicle and not know that you are hitting something,” said Mertrae. “He could have stopped immediately. He chose not to. When he realized he wasn’t going to be able to get out of this situation he pulled over. He pulls over and removes the evidence.”
Eventually, judge Michael Silvanio Side with the prosecution on Tuesday and all the charges against Higgins confirmed.
Silvanio said, “There is no belief in the argument that there is a proportional negligence on behalf of the cyclists.”
