The British man who was detained in India for six years without a high -profile corruption case must be released on his own recognizance, ruled the Supreme Court in Delhi.
Christian James Michel, armament consultant, is accused of bribing Indian officials to win a helicopter contract for multi-millions for the British-Italian defense company Agustawestland. He denies the charge.
It was extradited to India from the United Arab Emirates in 2018 and has since been in custody, in that the judge called the “exceptional” situation.
Agustawestland’s controversy was one of several cases of corruption related to the former India party party, some of which eventually came out.
In 2010, the Indian government signed a transaction with the Agustawestland maternal company on the purchase of 12 helicopters.
The alleged violations were born when the Federal India’s Federal Revision reported that the government may have significantly overplain the $ 753 million agreement (£ 455 million) that was Eventually cut off in 2014.
According to the court documents, Michel, allegedly received about 42 million euros ($ 44.7 million, 25 million pounds) for providing a contract. His lawyer claimed that there was no evidence that would bind him to allegedly a crime.
The Mr. Michel investigations were conducted by Mr. Michel’s financial crimes and internal crimes agencies.
But both of these investigations are not yet completed, and the lawsuits have not yet begun, which will lead to the “prolonged imprisonment” of Mr. Michel, said the Supreme Court of Delhi.
The judge stated that his six years of the defendant was also “anxiously close” to the maximum sentence of seven -year imprisonment for money laundering, which is one of the accusations he faces.
The court decided to provide a recognizance subscription in one of the cases after the Supreme Court did the same in another case on February 18.
This means that Mr Michel can now leave the Delhi Tihar prison jail, but he can’t leave India when his passport was confiscated.
The transaction for 12 three-rhyme helicopters AW-101 was signed in February 2010 after Agustawestland won the competition from us and Russian rivals.
The plane was intended for the elite squadron of the Indian Air Force, which goes around the president, the Prime Minister and other VIPS.
Before the transaction was made, only three helicopters were delivered.
Italian prosecutors suspected that almost $ 67.6 million were paid to Indian officials for providing a contract.
Giuseppe Orsa, former head of the Agustawestland parent company, who was called Finmeccanica at the time, and Bruno Spagnolini, a former leader of Acplestrandland, were convicted in Italy on charges of fraud and corruption.
Both were justified in 2018. Indian officials said their acquittal would not be involved in the case in India.
The head of the Indian Air Force at the time of the transaction was Arrested for bribery in 2016And later released on bail.
