South Carolina drunk driver arrested in December has been deported three times: Affidavit


An an illegal immigrant with a long criminal history in the United States, was indicted by a South Carolina grand jury last week for re-entry without a permit after he was arrested for driving under the influence in December.

Sergio Ixtepan-Toto, 36, was arrested on December 6, 2024. in Pickens, South Carolina, for driving under the influence after he nearly crashed into another vehicle on West Main Street in the city.

When a Pickens police officer tried to stop Ixstepan-Toto, he allegedly ran a stop sign and continued driving until officers cornered him in a store parking lot.

During the stop, officers reported that Ixtepan-Toto failed a field sobriety test and had several open cans of beer in his vehicle.

The incident report also said he had an ID from Mexico, This was reported by FOX Karolina.

Ixtepan-Toto was released on local charges and detained by Immigration and Customs Enforcement on December 9.

In an affidavit filed Dec. 12 by deportation officers, Ixtepan-Toto’s immigration case showed that he was deported in May 2020, November 2022 and February 2024.

“There is no record that Ixtepan ever received permission from the United States Attorney General or his successor, the Director of Homeland Security, to reapply to INS or ICE for admission to the United States after he was arrested and deported.” the affidavit said.

A background check of Ixtepan-Toto, obtained by FOX Carolina, showed criminal cases in various state jurisdictions since 2008.

His previous charges include speeding, driving without a license, domestic violence, indecent exposure and four previous DUI arrests.
